This Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your information when You use the Planitar Service (ā€œServiceā€) and tells You about Your privacy rights and how the law protects You.

  • Consumer means an individual that accesses, browses or otherwise uses the Service.  
  • Customer means a photographer, photography business, real estate agent, realtor or similar real estate business that subscribes to our Service.  
  • Cookies are small files that are placed on Your computer, mobile device, or any other device by a website, containing the details of Your browsing history on that website among its many uses.
  • Facebook Page is a public profile named iGUIDE specifically created by the Company on the Facebook social network, accessible from https://www.facebook.com/Planitar.
  • GDPR is General Data Protection Regulation.
  • NZPA means the Privacy Act 2020 (NZ).
  • Personal Information is any information that relates to an identified or identifiable individual.
    • For data subjects located in the EEA, any reference to Personal Information in this Privacy Policy refers to Personal Data, being, an identifiable individual is a person who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity.
    • For the purposes of the CCPA, Personal Information means any information that identifies, relates to, describes or is capable of being associated with, or could reasonably be linked, directly or indirectly, with You.
    • For Canadian users, Personal Information has the meaning set out in the PIPEDA.
    • For Australian users, Personal Information has the meaning set out in the APA.
    • For New Zealand users, Personal Information has the meaning set out in the NZPA.
  • PIPEDA means the Personal Information Protection and Electronic Documents Act.
  • Service refers to the Planitar website maintained by the Company and accessible via HTTPS at a domain or sub-domain of either youriguide.com, goiguide.com or iguide.au, including as accessible via the iGUIDE viewer application embedded into any third party website or application.
  • Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used. For the purpose of the GDPR, Service Providers are considered Processors.
  • Third-party social media service refers to any social network website through which a User can interact with the Service.
  • Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
  • You (referred to as either ā€œYourā€, ā€œUserā€) means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable. Under GDPR, You can be referred to as the Data Subject or as the User as You are the individual using the Service.

We collect Personal Information in a number of ways, including when you set up a Customer account and register to use the Service, when you access and use the Service, pay for a product or service provided by us, contact us, request us to provide additional services, participate in surveys or questionnaires and from data and other information you upload via the Service or approved third party products integrated or used in conjunction with the Service from time to time.

Tracking Technologies and Cookies

We use Cookies and similar tracking technologies to track the activity on Our Service and store certain information. Tracking technologies used are beacons, tags, and scripts to collect and track information and to improve and analyze Our Service.

  • We may have a legal obligation to participate in investigations and proceedings of public authorities and the government. The legal basis for such processing is Art. 6 (1) 1 lit. c GDPR in connection with the respective provision establishing our legal obligations.
  • We may also process Your Personal Data to protect our rights and safety, our contract and business partners and others, including through assertion of or participation in legal proceedings. The legal basis for this data processing is either a respective legal obligation to this effect (Art. 6 (1) 1 lit. c GDPR in connection with the relevant legal provisions) or our legitimate interest or of those affected to assert legal claims (Art. 6 (1) 1 lit. f GDPR).

Recipients of Personal Data under the GDPR

For some of the aforementioned purposes we may disclose your Personal Data to other parties. In addition to any recipients already mentioned in this Privacy Policy, these categories of recipients include processors acting on our behalf and bound by our instructions, such as communication service providers (e.g., mail relay providers), newsletter and contact form providers, IT and IT security providers and software providers (including software as a service solutions).

The legal basis for respective data sharing is Art. 28 GDPR in connection with the respective data processing agreement concluded with the recipient.

We may also share your personal data with other third parties as outlined above under Legal Basis and Purposes for Processing Personal Data under GDPR.

Cross-Border Transfers of Personal Data under the GDPR

When sharing Your Personal Data with external recipients (see above), some of Your Personal Data may be transferred to other companies within Canada or the US, which are subject to adequacy decision by the European Commission. Data recipients in the US are certified under the EU-US Data Privacy Framework.

Please note that data processed in a country outside the EEA may be subject to foreign laws and accessible to foreign governments, courts, law enforcement, and regulatory agencies. However, We will endeavor to take the required measures to maintain an adequate level of data protection when sharing your Personal Data with recipients established in such countries.

In the case of a transfer to a country outside of the EEA, this transfer is subject to appropriate safeguards and where necessary safeguarded by the conclusion of EU Standard contractual clauses and additional measures, if necessary.

Retention of Your Personal Data under the GDPR

The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain Your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

Your Data Subject Rights under the GDPR

The Company undertakes to respect the confidentiality of Your Personal Data and to guarantee You can exercise Your rights under the GDPR.

You have the right under this Privacy Policy, and by law if You are within the EEA, to:

Please note that this right only applies to automated information which You initially provided consent for Us to use or where We used the information to carry out a contract with You.
  • Withdraw Your consent. You have the right to withdraw Your consent on using Your Personal Data. If You withdraw Your consent, We may not be able to provide You with access to certain specific functionalities of the Service.

Facebook Page

Controller for the Facebook Page

The Company is the Controller of Your Personal Data collected while using the Facebook Page. As operator of the Facebook Page, the Company and the operator of the social network Meta are Joint Controllers.

Facebook Insights

We use the Meta Insights function in connection with the operation of the Facebook Page and based on the GDPR, to obtain anonymized statistical data about Our users.

For this purpose, Meta places a Cookie on the device of the user visiting Our Facebook Page. Each Cookie contains a unique identifier code and remains active for two years, except when deleted before the end of this period.

Meta receives, records, and processes the information stored in the Cookie, especially when the user visits the Meta services, services that are provided by other members of the Facebook Page and services by other companies that use Meta services. CCPA Privacy Addendum

This addendum applies to you if you are CCPA Consumer.

In the event of inconsistency between the terms of this Privacy Addendum and the Privacy Policy, the specific terms of this addendum prevail.

Definitions

In this Addendum, defined terms have the following meanings:

  • Business, for the purpose of the CCPA, refers to the Company as the legal entity that collects CCPA Consumers’ Personal Information and determines the purposes and means of the processing of CCPA Consumers’ Personal Information, or on behalf of which such information is collected and that alone, or jointly with others, determines the purposes and means of the processing of consumers’ Personal Information, that does business in the State of California.
  • CCPA Consumer, for the purpose of the CCPA, means a natural person who is a California resident. A resident, as defined in the law, includes; (1) every individual who is in the USA for other than a temporary or transitory purpose, and (2) every individual who is domiciled in the USA who is outside the USA for a temporary or transitory purpose.
  • CPRA is California Privacy Rights Act.
  • Do Not Track (DNT) is a concept that has been promoted by US regulatory authorities, in particular the U.S. Federal Trade Commission (FTC), for the Internet industry to develop and implement a mechanism for allowing internet users to control the tracking of their online activities across websites.
  • Sale, for the purpose of the CCPA, means selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a CCPA Consumer’s Personal information to another business or a third-party for monetary or other valuable consideration.

Your Rights under the CCPA

Under this Privacy Policy, and by law if You are a resident of California, You have the following rights:

  • The right to notice. You must be properly notified which categories of Personal Information are being collected and the purposes for which the Personal Information is being used.
  • The right to access / the right to request. The CCPA permits You to request and obtain from the Company information regarding the disclosure of Your Personal Information that has been collected in the past 12 months by the Company or its subsidiaries to a third-party for the third-party’s direct marketing purposes.
  • The right to say no to the Sale of Personal Information. You also have the right to ask the Company not to sell Your Personal Information to third parties. As described in the Disclosure of Your Personal Information section, We will not sell any of the Personal Information that we collect about You.
  • The right to know about Your Personal Information. You have the right to request and obtain from the Company information regarding the disclosure of the following:
    • The categories of Personal Information collected
    • The sources from which the Personal Information was collected
    • The business or commercial purpose for collecting or selling the Personal Information 
    • Categories of third parties with whom We share Personal Information
    • The specific pieces of Personal Information we collected about You
  • The right to delete Personal Information. You also have the right to request the deletion of Your Personal Information that has been collected in the past 12 months.
  • The right not to be discriminated against. You have the right not to be discriminated against for exercising any of Your CCPA Consumer rights, including by:
    • Denying goods or services to You
    • Charging different prices or rates for goods or services, including the use of discounts or other benefits or imposing penalties
    • Providing a different level or quality of goods or services to You
    • Suggesting that You will receive a different price or rate for goods or services or a different level or quality of goods or services.

Exercising Your CCPA Data Protection Rights

To exercise any of Your rights under the CCPA, and if You are a California resident, You can contact Us using the information found in the ā€œContact Usā€ section below.

The Company will disclose and deliver the required information free of charge within 45 days of receiving Your verified request. The period to provide the required information may be extended once by an additional 45 days when necessary and with prior notice.

Do Not Sell My Personal Information

We do not sell Personal Information. However, the Service Providers we partner with (for example, our advertising partners) may use technology on the Service that ā€œsellsā€ Personal Information as defined by the CCPA law.

If You wish to opt out of the use of Your Personal Information for interest-based advertising purposes and these potential sales as defined under CCPA law, please see the ā€œTracking Technologies and Cookiesā€ and ā€œBehavioral Remarketingā€ sections above.

The opt out will place a Cookie on Your computer that is unique to the browser You use to opt out. If You change browsers or delete the Cookies saved by Your browser, You will need to opt out again.

Mobile Devices

Your mobile device may give You the ability to opt out of the use of app Usage Data for Behavioral Remarketing, using the following settings:

  • ā€œOpt out of Interest-Based Adsā€ or ā€œOpt out of Ads Personalizationā€ on Android devices
  • ā€œLimit Ad Trackingā€ on iOS devices

You can also stop the collection of location information from Your mobile device by changing the preferences on Your mobile device.

ā€œDo Not Trackā€ Policy as Required by California Online Privacy Protection Act CalOPPA

Our Service does not respond to Do Not Track DNT signals.

However, some third-party websites do keep track of Your browsing activities. If You are visiting such websites, You can set Your preferences in Your web browser to inform websites that You do not want to be tracked. You can enable or disable DNT by visiting the preferences or settings page of Your web browser.

Children’s Privacy

Our Service does not address anyone under the age of 13. We do not knowingly collect Personal Information from anyone under 13. If You are a parent or guardian and You are aware that Your child has provided Us with Personal Information, please contact Us. If We become aware that We have collected Personal Information from anyone under the age of 13 without verification of parental consent, We will take steps to remove that information from Our servers.

We also may limit how We collect, use, and store some of the information of Users between 13 and 18 years old. In some cases, this means We will be unable to provide certain functionality of the Service to these users.

Australian and New Zealand Privacy Addendum

This addendum applies to you if you are a Customer or Consumer of the Service in Australia or New Zealand.

What Happens if You Don’t Provide us With The Information We Require?

As a Consumer, you can engage with the Service anonymously.  

As a Customer, if you don’t provide us with certain information we request, we may be unable to provide you the information, products or services you wish to buy or receive. If, as a Customer, you wish to remain anonymous or to use a pseudonym when dealing with us, we may be able to provide you with limited information or services. However, in many cases it will not be possible for us to assist you with your specific needs if you wish to remain anonymous or use a pseudonym.

Personal Information security

We will take commercially reasonable and appropriate steps to ensure Personal Information is protected from risks such as loss, interference, unauthorised access or use, destruction, modification or disclosure. For example, we only permit our authorised personnel to access Personal Information.

The Internet is not a secure method of transmitting information. Accordingly, we cannot accept responsibility for the security of information you send to or receive from us or for any unauthorised access, use or modification of that information.

Where Your Information is Stored

Our hosting service providers (including Amazon Web Services and its related bodies corporate (AWS)), support service providers (including our contractors) and other third party service providers may transmit, maintain and store all or parts of Personal Information, data and information on multiple servers across various jurisdictions.  As an Australian or New Zealand user of the Service, your data will ordinarily be stored on our primary AWS servers in Australia.  

Personal Information may also be transferred between related bodies corporate of Planitar that are located in different jurisdictions or for backup or to reduce latency. Servers in which your information (including Personal Information) may be stored by our hosting service providers and support service providers are likely to be in Australia with secondary regions in Singapore, Japan, Canada and the United States.

Your Rights of Access and Correction

If you wish to access your Personal Information, or believe that any of the Personal Information we hold about you is inaccurate, incomplete, irrelevant, out-of-date or misleading, please contact us at the email address shown in this Privacy Policy. If reasonable and practicable to do so, we will provide access in the form requested by you. We will take reasonable steps to correct any inaccurate, incomplete, out-of-date, irrelevant or misleading Personal Information if you request us to do so, where required by law. If we decline to make the requested amendment for reasons permitted by the APA or NZPA, we will include a note with that Personal Information in your file outlining that you have requested it to be amended, if you ask us to do so.

We may withhold or refuse you access to Personal Information if we are legally authorised to do so or where its disclosure to you is restricted by law, is the subject of legal action, or may compromise the privacy of another person. We will give you reasons explaining why we have refused access, or refused access in the form you have requested, unless it would be unreasonable to do so, having regard to the reasons for our refusal.

We may charge you a reasonable fee to access your information as permitted by applicable law.

How Can You Stop Receiving Marketing Information?

Where marketing information is forwarded to you via electronic messages, there will be a functional ā€˜unsubscribe’ mechanism contained in the message.

If you no longer wish to be contacted by us or receive such marketing information, you can advise us by clicking the ā€˜unsubscribe function’ (where marketing information is sent electronically).

We will keep a record of your request to ensure you do not receive that information in the future. You cannot refuse to receive information that we are required to provide you by law.
